Technology Provider

The ShipGoPick portal and this website are designed, built and maintained by The Laddership by Panthrai OPC Consulting Private Limited (“the Technology Provider”). This page sets out what that means, and — more importantly — what it does not.

Software only

The Laddership by Panthrai OPC Consulting Private Limited supplies software. It does not source products, manufacture goods, hold stock, pack parcels, carry freight, clear customs, or handle your money.

Every shipping, sourcing, storage and fulfilment service described on this site is provided by PGM Distributors and by the couriers, manufacturers and logistics partners it engages. Your contract for those services is with PGM Distributors — not with the Technology Provider.

No liability for shipments or goods

The Laddership by Panthrai OPC Consulting Private Limited carries no liability for any loss, damage, delay, seizure, mis-declaration, customs outcome, duty assessment, product defect, regulatory penalty or commercial loss arising from goods sourced, stored, shipped or sold through ShipGoPick. Any claim of that kind lies against PGM Distributors or the relevant carrier, under the terms and limits of carriage that apply to the consignment.

PGM Distributors indemnifies and holds harmless The Laddership by Panthrai OPC Consulting Private Limited, together with its directors, officers, employees and contractors, against claims, demands, proceedings, losses and costs brought by any third party in connection with the shipping, sourcing, storage, labelling, export or sale of goods through ShipGoPick.

What the Technology Provider is responsible for

So the limit above is not mistaken for no responsibility at all, the Technology Provider remains responsible for the things it actually controls:

• Building and maintaining the portal software to a reasonable professional standard.
• Applying reasonable technical measures to protect data held in the systems it operates.
• Fixing defects in that software within a reasonable period of being told about them.

The software is provided on an as-is basis. It is not warranted to be uninterrupted or error-free, and the Technology Provider does not warrant that any rate, estimate, duty figure or transit time shown in it will prove correct — those come from carriers and authorities, and they change.

Data

The Technology Provider processes data on behalf of PGM Distributors and only as needed to run and support the service. It does not sell that data or use it for its own marketing. What is collected from this website, and why, is set out in the Privacy Policy.

Relationship to the other terms

This page forms part of the Terms of Service and should be read with the Disclaimer. Where they conflict on the question of the Technology Provider’s liability, this page governs.
